Welcome to the official digital platform of DEVI DHAAM LAUA SEWA FOUNDATION (a Section 8 Company). By accessing this website (devidhamtrust.org), you unconditionally agree to the following terms. If you do not agree, please cease use immediately.
1. LEGAL CONSTITUTION
DEVI DHAAM LAUA SEWA FOUNDATION is a non-profit company incorporated under Section 8 of the Companies Act, 2013 CIN:U94910MP2025NPL07928. Our mission is strictly charitable, and all operations are governed by the Ministry of Corporate Affairs, India.
2. DONATION COMPLIANCE & ANTI-MONEY LAUNDERING (AML)
- Source of Funds: By making a donation, the donor declares that the funds are from a legitimate source and do not violate the Prevention of Money Laundering Act (PMLA), 2002.
- KYC Requirements: For high-value donations, the Foundation reserves the right to request a PAN card or other Government IDs to comply with Income Tax and Ministry of Home Affairs (MHA) regulations.
- No Foreign Contribution (FCRA): Unless explicitly stated otherwise, we do not accept foreign contributions. Donors must be Indian Citizens with Indian Bank Accounts.
- Non-Refundable Policy: Donations are treated as "Irrevocable Gifts" for social causes. No refund requests will be entertained once the 80G receipt is generated.
3. INTELLECTUAL PROPERTY & BRAND PROTECTION
- Exclusive Ownership: The name "Devi Dhaam Laua Sewa Foundation," its logo, website code, and content are protected under the Copyright Act, 1957 and Trademark Act, 1999.
- Prohibited Use: Any unauthorized use of our branding for fundraising by third parties will lead to immediate legal action and a report to the Cyber Cell.
4. DATA PRIVACY (DPDP ACT 2023 COMPLIANCE)
We respect the Digital Personal Data Protection Act, 2023. Any personal data (Name, Phone, PAN) collected during the donation process is used strictly for issuing receipts and audit compliance. We do not sell or trade user data.
5. LIMITATION OF LIABILITY & "AS-IS" CLAUSE
- No Warranty: The website is provided on an "As-Is" and "As-Available" basis. We do not guarantee that the server will be 100% error-free or immune to cyber-attacks.
- Indirect Loss: The Foundation, its Directors, or employees shall not be liable for any technical failures, payment gateway delays, or loss of data during transactions.
6. INDEMNIFICATION
You agree to indemnify and hold harmless DEVI DHAAM LAUA SEWA FOUNDATION from any claims, losses, or legal fees resulting from your violation of these terms or misuse of the website's services.
7. FORCE MAJEURE
The Foundation shall not be held responsible for any failure to perform its obligations (like issuing receipts or updating project status) due to circumstances beyond its control, such as natural disasters, government restrictions, or nationwide internet outages.
8. DISPUTE RESOLUTION & JURISDICTION
- Arbitration: In the event of a dispute, both parties agree to first attempt an amicable settlement.
- Exclusive Jurisdiction: Any unresolved legal matters shall be subject to the exclusive jurisdiction of the Courts of Sidhi, Madhya Pradesh, India.
